It should be at the discretion of the state. The state arguably should be able to supervene in extraordinary circumstances. Leaving the selective pressure on the local level can create local political incentives for bribery or tithe to allow the process. I'd argue for open/porous transfer at that level, based on state constitutional change, but the state could grant oversight at the local levels.
